HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Peaceful Weigh to Wellness LLC (“Peaceful Weigh,” “we,” “us,” or “our”) is committed to protecting the privacy and security of your Protected Health Information (“PHI”). We are required by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), as amended, and other applicable laws to maintain the privacy of your health information, provide you with this Notice of Privacy Practices, and abide by the terms of this Notice currently in effect.

This Notice applies to all healthcare services provided by Peaceful Weigh to Wellness LLC and its workforce members, contracted healthcare providers, and business associates who assist in providing healthcare services.

Our Legal Responsibilities

We are required by law to:

  • Maintain the privacy and security of your Protected Health Information (“PHI”);
  • Provide you with this Notice explaining our legal duties and privacy practices;
  • Notify you if a breach of your unsecured PHI occurs when required by law;

What Is Protected Health Information?

Protected Health Information (“PHI”) is information that identifies you and relates to:

We may use and disclose your PHI to obtain payment for healthcare services. Examples include:

We may use and disclose your PHI for legitimate business and healthcare operations, including:

Business Associates are contractually required to safeguard your PHI and may only use or disclose it as permitted by law.

Unless you object, we may share relevant information with:

      • Family members
      • Caregivers
      • Legal guardians
      • Personal representatives

when appropriate to assist in your care or payment for your care.

7. Public Health and Legal Requirements

We may disclose PHI when required or permitted by law, including for:

    • Public health reporting
    • Disease prevention
    • FDA reporting
    • Abuse or neglect reporting
    • Court orders
    • Law enforcement requests
    • Government oversight activities
    • Workers’ compensation claims
    • National security purposes

8. Research

We may use or disclose PHI for research purposes only as permitted by applicable law and subject to appropriate safeguards.

Uses Requiring Your Authorization

Except as described above, we will obtain your written authorization before using or disclosing your PHI for:

      • Marketing purposes where authorization is required;
      • The sale of PHI;
      • Most psychotherapy notes; or
      • Other uses requiring authorization under HIPAA.

You may revoke your authorization at any time in writing, except to the extent we have already relied upon it.

Your Rights

Under HIPAA and other applicable laws, you have the right to inspect and obtain copies of your Protected Health Information (“PHI”), request amendments if you believe your medical information is incorrect or incomplete (subject to applicable legal limitations), request

restrictions on certain uses or disclosures of your PHI (although we are not always required to agree), request that we communicate with you in a specific manner or at a specific location,

receive an accounting of certain disclosures of your PHI made during the previous six years (excluding disclosures for treatment, payment, healthcare operations, and other exceptions permitted by law), obtain a paper copy of this Notice at any time even if you previously agreed to receive it electronically, and file a complaint if you believe your privacy rights have been violated without fear of retaliation.

Our Commitment to Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect your PHI from unauthorized access, use, disclosure, alteration, or destruction.

While we strive to protect electronic information, no method of electronic transmission or storage is completely secure.

Telehealth Services

Peaceful Weigh to Wellness LLC provides healthcare services through telehealth technologies.

Telehealth services may involve the electronic transmission of medical information, images, questionnaires, audio, video, laboratory results, prescriptions, and other health information necessary to provide treatment.

By utilizing our services, you acknowledge that electronic communications carry inherent privacy and security risks despite reasonable safeguards.

Changes to This Notice

We reserve the right to change this Notice at any time.

Any revised Notice will apply to all PHI maintained by Peaceful Weigh to Wellness LLC and will become effective upon posting on our website or otherwise making it available to patients.

The Effective Date at the top of this Notice indicates the most recent revision.
